Master Terms and Conditions

Weight of War LIMITED (ACN 698 550 999) Effective Date: 23 June 2026

Welcome to Weight of War. These Master Terms and Conditions ("Terms") govern your use of the Weight of War website, your purchase of merchandise, your charitable donations, and your physical participation in our events.

By accessing our website, making a purchase, donating, or registering for an event, you acknowledge that you have read, understood, and agree to be bound by these Terms.

PART A: WEBSITE, DONATIONS & E-COMMERCE

1. General Website Use

(a) This website is operated by Weight of War Ltd ("we", "us", "our").

(b) You agree to use this website only for lawful purposes. You must not use our site to engage in any fraudulent activity, distribute malware, or attempt to breach our security or servers.

(c) Intellectual Property: All content on this website, including but not limited to the "Weight of War" name, logos, graphics, text, and event structures, is the exclusive property of Weight of War Ltd and is protected by Australian copyright and trademark laws. You may not reproduce, distribute, or commercially exploit our intellectual property without express written permission.

2. Donations & Fundraising

As a direct-action charity, we rely on public support to fund our veteran rehabilitation and mentorship pipelines.

(a) Non-Refundability: Except where required by Australian Consumer Law, all voluntary donations made to Weight of War Ltd (either directly or via third-party platforms like Chuffed.org) are final and strictly non-refundable.

(b) Fund Allocation: Undesignated donations will be split equally between our primary partner charities (e.g., Zero79 Foundation and Survive To Thrive Nation), minus essential administrative and operational retention as determined by the Board to maintain charity compliance and public liability insurance.

(c) Tax Deductibility: Weight of War Ltd is a registered Australian public company limited by guarantee and an ACNC-registered charity. Please refer to our current Deductible Gift Recipient (DGR) status on the website or consult a tax professional regarding the tax deductibility of your contribution.

3. Shop & Merchandise (E-Commerce)

(a) Pricing & Payment: All prices in our online shop are listed in Australian Dollars (AUD). We use secure third-party payment gateways (e.g., Stripe, PayPal). We do not store your raw credit card data.

(b) Shipping: We aim to dispatch all merchandise orders promptly. However, as a volunteer-led charity, dispatch times may vary. We are not liable for delays caused by third-party postal carriers.

(c) Returns & Exchanges: We comply strictly with Australian Consumer Law. If a product you purchase is faulty, significantly different from the description, or unsafe, you are entitled to a refund or replacement. We do not offer refunds for "change of mind" or incorrect sizing once an item has been worn or washed.

4. Third-Party Platforms

Our website contains links to external platforms (such as Chuffed for crowdfunding, Wix for hosting, or partner charity websites). We are not responsible for the content, privacy policies, or terms of use of these external sites.

PART B: EVENT PARTICIPATION & LIABILITY WAIVER

The following terms apply specifically to any individual ("Participant", "I", "my") registering for, attending, or participating in the Weight of War Run (the "Event").

5. Assumption of Inherent Risks

I acknowledge that the Weight of War Run is an extreme physical endurance event. I understand that:

(a) The Event involves strenuous physical exertion, including but not limited to, running or walking up to 21km while optionally wearing a 10kg weighted vest. This places extreme stress on the cardiovascular, musculoskeletal, and respiratory systems.

(b) There is a real risk of serious injury, illness, or death arising from participation. Risks include, but are not limited to: heat exhaustion, heatstroke, dehydration, spinal or joint injuries (exacerbated by the weighted vest), heart failure, and collisions.

(c) The Event is held on shared public pathways, boardwalks, and road crossings not exclusively owned or controlled by Weight of War Ltd. Hazards such as uneven surfaces, pedestrians, cyclists, and vehicular traffic are to be expected.

(d) I am voluntarily participating in this Event with full knowledge and acceptance of all inherent physical and environmental risks.

6. Fitness to Participate & Medical Consent

(a) I declare that I am medically and physically fit to participate in the Event. I have no known medical conditions, impairments, or injuries that would make my participation hazardous to myself or others.

(b) I acknowledge that it is my responsibility to consult a medical practitioner prior to the Event if I am uncertain about my health or fitness level.

(c) Consent to Medical Treatment: In the event of injury, illness, or heat distress, I consent to receive emergency medical care and first aid from the Organiser's contracted medical professionals, volunteers, or State Emergency Services.

(d) Heat Mitigation: I explicitly consent to being directed into ice bath immersion recovery stations by Event medical staff or the Basecamp Commander if I exhibit signs of dangerous core body temperature elevation.

(e) I assume full financial liability for any medical expenses incurred as a result of my participation (including ambulance transport and hospital admittance) that are not provided free-of-charge.

7. Release of Liability and Indemnity

In consideration of Weight of War Ltd permitting me to participate in the Event, I hereby:

(a) Release: Fully and forever release, waive, and discharge Weight of War Ltd, its Directors, the Zero79 Foundation, Survive To Thrive Nation, the venue owners (including all regional Basecamp venue partners), sponsors, traffic controllers, medical contractors, and volunteers (the "Indemnified Parties") from any and all claims, demands, or causes of action for death, personal injury, property damage, or loss arising out of my participation in the Event.

(b) Indemnify: Agree to indemnify and hold harmless the Indemnified Parties from any liabilities, claims, costs, or expenses (including legal fees) arising from my acts or omissions during the Event, or the acts or omissions of other participants, except to the extent that such loss was caused by the gross negligence of the Organisers.

(c) Sole Risk: I acknowledge that my participation is entirely at my own risk. I am solely responsible for the security of my personal belongings at the Basecamp bag-drop.

8. Event Rules, Attire, and Pathway Etiquette

I agree to strictly abide by all rules, safety briefings, and directions issued by Weight of War Ltd, the Basecamp Commander, and roving marshals:

(a) Pathway Etiquette: I understand this is not a closed-course timed race. I will obey the strict "Keep Left" policy on all public pathways, footpaths, and riverwalks to ensure the safety of the general public.

(b) Traffic Control: I will strictly obey the directions of certified professional Traffic Controllers and police at all designated road crossings.

(c) Attire & Equipment: I will wear sports-specific attire (including appropriate running footwear and "budgy smugglers" or equivalent athletic wear). If I choose to wear a weight vest, I accept full responsibility for ensuring it is securely fitted and safe.

(d) Right of Removal: I acknowledge that the Basecamp Commander or Event medical staff hold the absolute right to terminate my participation, remove me from the course, or confiscate my weight vest at any time if they believe my health is at risk, or if I fail to comply with safety instructions.

9. Australian Consumer Law & Statutory Guarantees

I acknowledge that Weight of War Ltd is providing a "recreational service" under the Competition and Consumer Act 2010 (Cth) and relevant state and territory legislation, including the Civil Liability Act 2003 (Qld), the Civil Liability Act 2002 (NSW), the Civil Liability Act 2002 (WA), and the Civil Law (Wrongs) Act 2002 (ACT). To the maximum extent permitted by law across these jurisdictions, the Organiser excludes all liability for:

(a) Death;

(b) Physical or mental injury (including the aggravation, acceleration, or recurrence of such an injury); or

(c) The contraction, aggravation, or acceleration of a disease,

arising from a failure to comply with any statutory guarantees in relation to the supply of these recreational services.

10. Event Cancellation

The Organiser reserves the right to alter the route, change the start time, or cancel the Event entirely due to extreme weather (e.g., severe storms, dangerous heat indexes), "Acts of God," or instructions from emergency services. Voluntary donations attached to event registration remain non-refundable in the event of cancellation.

 

11. Privacy, Data Collection, and OPSEC

(a) I acknowledge that my personal and sensitive (medical) information is collected, used, and stored in accordance with the official Weight of War Ltd Privacy Policy.

(b) This information is collected for the primary purpose of ensuring Event safety, facilitating medical response, and managing placements into partner programs.

(c) OPSEC Exception: Active-duty personnel bound by strict Operational Security (OPSEC) requirements may register pseudonymously via vetted partners (e.g., Zero79 Foundation), provided a secure, offline medical waiver is verified by Event Command prior to participation.

 

12. Media and Photography Consent

(a) I grant Weight of War Ltd, its authorised contractors, and sponsors the irrevocable, royalty-free right to use my name, image, likeness, and voice in any media (including social media, websites, and promotional materials) for the purpose of promoting the charity and raising awareness for veteran mental health.

(b) If I do not wish to be photographed or filmed (due to OPSEC or personal preference), I acknowledge it is my responsibility to explicitly notify the Basecamp Commander or registration staff upon arrival.

13. Minors

I certify that I am 18 years of age or older. If I am registering a participant under the age of 18, I declare that I am their parent or legal guardian, and I have read, understood, and accept these Terms and Conditions on their behalf.

PART C: GOVERNING LAW & DECLARATION

14. Jurisdiction

(a) Website & General Terms: Part A of these Terms, and your general use of this website, shall be governed by the laws of Queensland, Australia.

(b) Event Participation: Part B (the Event Liability Waiver) is dynamically governed by the laws of the specific State or Territory in which the physical Event you are participating in is held (Queensland, New South Wales, Western Australia, or the Australian Capital Territory).

15. Declaration

By continuing to use this website, purchasing merchandise, or by checking the "I Agree" box during digital event registration, I legally bind myself, my heirs, executors, and administrators to these Master Terms and Conditions.
